Service Description

PhotoHeirloom is a photo preservation and family tree building service that allows you to upload, enhance, and share family photos and videos. We offer AI-powered photo restoration features.

User Accounts

• You must be at least 13 years old to use this service
• You must provide accurate and complete information
• You are responsible for maintaining the security of your account
• You are responsible for all activities under your account

User Content

Regarding content you upload:

• You retain ownership of your photos and content
• You grant us a license to host, process, and display your content as needed to provide our service
• You are responsible for ensuring you have the right to upload content

Prohibited Uses

You may not use our service to:

• Upload illegal content
• Upload harmful, offensive, or inappropriate content
• Infringe on others' intellectual property rights
• Send spam or unsolicited messages
• Upload malware or malicious code
• Interfere with the operation of our service

AI Features

Our AI photo restoration features are provided 'as is'. Results may vary and we do not guarantee specific outcomes. AI-generated content may not be historically accurate.

Third-Party Integrations

PhotoHeirloom integrates with third-party services to enhance your experience. By using these integrations, you agree to the respective third-party terms of service.

Google Contacts

When you connect your Google account, PhotoHeirloom accesses your Google Contacts (read-only) to help you quickly find and invite family members. This integration requires your explicit consent and can be disconnected at any time from your account settings. We only access contact names and email addresses, and this data is not stored on our servers.

Google Maps

We use Google Maps Platform to provide location autocomplete when adding location information to your photos. This helps you accurately record where family photos were taken. Location data you enter is stored with your photos but is not shared with Google beyond the autocomplete request.

These integrations are subject to change. We may add, modify, or remove third-party integrations with reasonable notice to users.

Payment and Subscriptions

Some features may require a paid subscription. Prices and terms will be clearly displayed before purchase. Refunds are handled according to our refund policy.

Account Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time through your account settings.

Disclaimer of Warranties

Our service is provided 'as is' without warranties of any kind. We do not guarantee uninterrupted or error-free service.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of our service.

Changes to Terms

Indemnification

You agree to indemnify, defend, and hold harmless PhotoHeirloom, its operator, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: (a) your violation of these Terms, (b) your violation of any rights of another party, including intellectual property rights or privacy rights, (c) any content you upload to the service, or (d) your use or misuse of the service.

Dispute Resolution

In the event of any dispute arising from these Terms or your use of the service, you agree to first contact us at [email protected] to attempt an informal resolution. If we cannot resolve the dispute informally within 30 days, any legal disputes shall be resolved exclusively in the courts of Tel Aviv, Israel, under Israeli law.

Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, riots, natural disasters, pandemics, epidemics, internet service provider failures, network infrastructure failures, server outages, cyber attacks, governmental actions, changes in law, or labor disputes.

Severability

If any provision of these Terms is found to be unenforceable, unlawful, or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

Entire Agreement

These Terms of Service, together with our Privacy Policy, Refund Policy, and any other legal notices published by us on the service, shall constitute the entire agreement between you and PhotoHeirloom concerning the service. These Terms supersede all prior or contemporaneous agreements, negotiations, representations, and proposals, whether written or oral.

Governing Law

These terms are governed by the laws of Israel. Any disputes shall be resolved in the courts of Tel Aviv, Israel.
